Please read these Terms and Conditions ("Terms") carefully before using www.vividpixels.co.uk (the "Website") or placing an order with us. By using the Website or placing an order, you agree to be bound by these Terms.
1. About Us
1.1 The Website is operated by John Leaver, trading as Vivid Pixels ("we", "us", "our"). Vivid Pixels is a sole trader business, not a registered company. As required under UK law, we display our trading name (Vivid Pixels) alongside the legal name of the trader above.
1.2 Business address: 247 Kingsbridge Road, Morden, Surrey, SM4 4PX
1.3 We are not currently VAT registered, so no VAT is charged on orders.
1.4 Contact email: jleaver247@gmail.com
2. Definitions
- "Products" means the artwork prints offered for sale on the Website, comprising canvas prints and fine art paper prints.
- "You" or "Customer" means the person purchasing or browsing the Website.
- "Contract" means the contract between us and you for the sale and purchase of Products, formed in accordance with Clause 5.
- "Printumo" means Printumo ApS (Pilestræde 41, 2, 1112 København K, Denmark, CVR 45022668), our third-party print-on-demand production and fulfilment partner.
3. Nature of Our Products
3.1 All Products sold on the Website are giclée reproduction prints of original artwork, produced by our fulfilment partner, Printumo, and are not hand-painted originals unless a specific listing expressly states otherwise.
3.2 Canvas prints are hand-stretched onto a wooden frame and supplied ready to hang, printed flat (no raised brushwork), unless the listing states otherwise.
3.3 Fine art paper prints are produced on archival paper with a natural matte finish and are supplied unframed unless the listing states otherwise.
3.4 Every Product is made to order. Nothing is printed or produced until you place an order, so please check sizing, orientation, and options carefully before checkout, as covered further in Clause 8.
3.5 We make reasonable efforts to accurately describe and photograph all Products. However, colours may vary slightly from the images shown due to differences in device screens, monitor calibration, and lighting conditions, and this is not considered a fault. Sizes listed are approximate and may vary slightly due to the nature of the printing and stretching process.
4. Prices and Payment
4.1 All prices on the Website are listed in GBP (£) and do not include VAT, as we are not VAT registered.
4.2 Delivery charges are additional and will be clearly shown at checkout before you complete your order.
4.3 We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.
4.4 In the event of a genuine pricing error, we reserve the right to cancel the order and provide a full refund, and we will notify you as soon as possible.
4.5 Payment must be made in full at the time of ordering. We currently accept payment by bank transfer or via PayPal. If paying by bank transfer, your order will not be processed until cleared funds have been received. We do not store your full card or bank details.
5. Orders and Contract Formation
5.1 When you place an order, you will receive an order confirmation email. This confirms we have received your order but does not constitute acceptance of it.
5.2 A binding Contract is formed once we (or Printumo, on our behalf) send your order into production, at which point your order confirmation email becomes binding.
5.3 We reserve the right to refuse or cancel any order at our discretion — for example, where we identify a pricing or listing error, suspect fraudulent activity, or cannot obtain payment authorisation. If we cancel an order after payment has been taken, you will receive a full refund within 14 days.
5.4 It is your responsibility to check that the details you provide (delivery address, size, framing options, etc.) are correct before submitting your order — see Clause 7.1.
6. How Your Order Is Fulfilled
6.1 We use Printumo as our print-on-demand production and fulfilment partner. When you place an order, your chosen artwork, size, and format are sent directly to Printumo, who print, frame (where applicable), package, and ship the Product on our behalf.
6.2 Printumo has production facilities across the UK, EU, US, Canada, and Australia, and your order is typically produced at the facility closest to your delivery address to minimise delivery time and cost.
6.3 While Printumo physically produces and ships your order, Vivid Pixels remains the seller and is responsible to you as the retailer of record. Your contract for the purchase is with us, not with Printumo, and your statutory consumer rights (see Clause 9) are against us. This Website and Printumo's own terms work together to define our respective responsibilities, but they do not reduce your legal rights as a consumer.
7. Order Changes, Production, and Delivery
7.1 Because every order is sent into production quickly, orders generally cannot be changed or cancelled once production has started — including changes to sizing, framing, or the delivery address. Please double-check your order before completing checkout. If you need to amend or cancel an order, contact us immediately at jleaver247@gmail.com and we will do our best to catch it before it enters production, but we cannot guarantee this.
7.2 Typical production time is around 1 working day for orders produced in the UK and around 2 working days for orders produced elsewhere in the EU. Delivery typically takes a further 3–5 working days after dispatch, though this can vary by destination, and these are estimates rather than guaranteed timeframes.
7.3 We currently deliver to addresses in the United Kingdom and Europe. If your delivery address is outside these regions, please contact us before ordering, as we may not be able to fulfil your order.
7.4 European orders: Because Printumo has production facilities within the EU, most European orders are printed and shipped from within the EU, which can reduce or avoid customs delays and import charges compared to shipping from the UK. However, depending on your country and Printumo's production location at the time of your order, your delivery may still be subject to your country's import VAT or handling fees. We are not VAT registered in the UK, so we do not charge VAT on the order itself; any VAT or duties applied on entry to your country are set by your local authorities, not by us, and are your responsibility. If a delivery is refused, or customs charges are declined by the recipient, no refund or replacement can be offered.
7.5 Please double-check your delivery address at checkout. We are not responsible for orders that are delayed, returned, or lost as a result of an incorrect or incomplete address supplied by you. If a parcel is returned to sender due to an incorrect address, we may, at our discretion, offer to resend it at your cost, but this is not guaranteed as the original item may be destroyed rather than returned to us.
7.6 Risk in the Product passes to you upon delivery. Title (ownership) passes to you once we have received payment in full.
8. Your Right to Cancel
8.1 Because every Product is made to order specifically for you — printed and, where applicable, framed to your chosen specification once your order is placed — your Product is treated as bespoke/personalised goods under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This means the standard 14-day "change of mind" cancellation right does not apply once your order has entered production.
8.2 You may still cancel free of charge before your order enters production, by contacting us immediately at jleaver247@gmail.com with your order number. Because production typically begins within hours of ordering, we cannot guarantee a cancellation request will reach us in time, but we will always try.
8.3 This clause does not affect your right to a repair, replacement, or refund if your Product arrives faulty, damaged, or not as described — see Clause 9 below, which is unaffected by the bespoke-goods exception.
9. Faulty, Damaged, or Incorrect Items
9.1 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, under which goods supplied to consumers must be as described, fit for purpose, and of satisfactory quality. These rights are against us (Vivid Pixels) as the seller, regardless of the fact that Printumo physically produces and ships your order.
9.2 If your Product arrives damaged, faulty, or different from what you ordered, please contact us within 48 hours of delivery at jleaver247@gmail.com with your order number and clear photographs of the issue (including the packaging, where relevant to a damage claim). Reporting promptly allows us to raise a claim with Printumo and resolve it quickly, though this time frame does not limit your longer-term statutory rights under the Consumer Rights Act 2015.
9.3 Where a claim is valid, we will arrange a free replacement at no extra cost to you, or a refund where a replacement is not appropriate or not wanted.
9.4 We are not able to offer a replacement or refund where an issue results from an incorrect address supplied by you, a delivery refused by you or your recipient, or damage caused after delivery through misuse, improper hanging, or exposure to unsuitable conditions (see Clause 10).
9.5 Under the Consumer Rights Act 2015, if a fault is identified within 30 days of delivery, you are generally entitled to a full refund; between 30 days and six months, you are typically entitled to a repair or replacement in the first instance. These statutory rights apply in addition to, and are not limited by, Clause 9.2's 48-hour reporting window for transit damage.
10. Care Instructions
10.1 To help preserve your Product:
- Avoid hanging in direct sunlight or areas of high humidity, which can cause fading or warping over time.
- Dust gently using a soft, dry cloth. Do not use liquid cleaners directly on the canvas or print surface.
- Handle fine art paper prints by the edges to avoid marking the surface.
10.2 We are not liable for deterioration of the Product caused by inappropriate care, environmental conditions, or improper handling after delivery.
11. Intellectual Property and Copyright
11.1 All artwork, images, designs, and content on the Website are the intellectual property of [YOUR NAME/ARTIST NAME] and are protected by copyright and other intellectual property laws.
11.2 Purchasing a Product gives you ownership of the physical print only. It does not grant you any copyright, licence, or right to reproduce, copy, scan, photograph for commercial use, distribute, publicly display for profit, or create derivative works from the artwork, in whole or in part, without our prior written consent.
11.3 You may not use images of Products from the Website for commercial purposes, resale, or promotional material without written permission.
11.4 Unauthorised reproduction of any artwork sold by Vivid Pixels may result in legal action.
11.5 Any artwork, images, or content you upload to the Website or send to us in connection with a custom order remains your property; we do not claim ownership of it and will only use it to fulfil your order unless you separately agree otherwise.
12. Website Use
12.1 You must be at least 18 years old, or have the consent of a parent/guardian, to place an order on the Website.
12.2 You agree to use the Website only for lawful purposes and not to attempt unauthorised access, introduce viruses or malware, use bots/scrapers to extract content, or post unlawful or infringing material via any interactive features of the Website.
12.3 We reserve the right to suspend or restrict access to the Website, or refuse service, at our discretion, including where we suspect misuse or fraudulent activity.
12.4 We do not guarantee that the Website will be available at all times, error-free, or uninterrupted, and we accept no liability for any loss arising from downtime, technical faults, or unavailability.
13. Limitation of Liability
13.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability which cannot be excluded or limited under applicable law.
13.2 Subject to Clause 13.1, our total liability to you in relation to any order shall not exceed the total price paid for the Product(s) giving rise to the claim.
13.3 We are not liable for any indirect or consequential loss, including but not limited to loss of profits, business, or opportunity, arising from your use of the Website or purchase of Products, except where such loss is a foreseeable result of our breach.
13.4 We are not responsible for delays or failures in performance resulting from causes beyond our reasonable control (see Clause 14), including delays or errors caused by our fulfilment partner, Printumo, or by shipping couriers, though we will always support you in resolving these with Printumo on your behalf.
14. Force Majeure
We will not be liable for any failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control, including but not limited to natural disasters, extreme weather, pandemic, industrial action, courier/postal delays, or supply chain or production disruption at Printumo's facilities.
15. Privacy and Data Protection
15.1 We process personal data in accordance with our [Privacy Policy], available at www.vividpixels.co.uk/privacy-policy, and in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
15.2 To fulfil your order, we share necessary details (such as your name, delivery address, and order specification) with Printumo, our fulfilment partner, solely for the purpose of producing and shipping your Product. Printumo processes this data under its own privacy policy, available at printumo.com/privacy-policy.
15.3 We do not sell your personal data to third parties. Please see our Privacy Policy for full details on data collection, use, storage, and your rights.
(Note: If you don't yet have a separate Privacy Policy page, this is a legal requirement under UK GDPR — I'm happy to draft one for you next.)
16. Cookies
The Website uses cookies to improve your browsing experience, analyse site traffic, and support essential functions such as the shopping basket. By using the Website, you consent to our use of cookies in accordance with our [Cookie Policy]. You can manage or disable cookies through your browser settings.
17. Complaints
If you have a complaint about your order or the Website, please contact us in the first instance at jleaver247@gmail.com. We aim to acknowledge complaints within [2–3] working days and resolve them as promptly as possible, liaising with Printumo where the issue relates to production or shipping.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices, our arrangement with Printumo, or legal requirements. The version in force at the time you place an order will apply to that order. Material changes will be indicated by an updated "Last updated" date at the top of this page.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court or competent authority, the remaining provisions will continue in full force and effect.
20. Governing Law and Jurisdiction
20.1 These Terms and any Contract between us are governed by the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales, save that consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts.
20.2 If you are a consumer resident in the European Union, nothing in these Terms deprives you of the protection afforded by any mandatory consumer protection provisions of the law of your country of residence which cannot be excluded by agreement.
